SUMMARY
Colorado repealed and reenacted its automated-decision framework. Beginning January 1, 2027, the law governs covered automated decision-making technology used to materially influence consequential decisions, including employment decisions.
WHY IT MATTERS
The enacted framework reaches employment eligibility and compensation decisions and assigns documentation, notice, data-access, correction, and human-review duties across developers and deployers.
KEY REQUIREMENTS
- Developers must provide deployers technical documentation addressing intended uses, training-data categories, known limitations, appropriate use, and human review.
- Deployers must provide required notices at the point of interaction and plain-language information after certain adverse outcomes.
- Consumers may request personal data, correction of factually inaccurate data, and meaningful human review and reconsideration after an adverse outcome.
- Developers and deployers must retain records needed to demonstrate compliance for at least three years.
COVERAGE
Employers: Organizations acting as developers or deployers of covered ADMT, subject to statutory definitions and exemptions.
Workers: Individuals affected by covered consequential decisions, including employment-related decisions.
Exceptions: The act contains specified exemptions and compliance provisions for certain regulated entities and uses.
ENFORCEMENT & PENALTIES
Exclusive enforcement by the Colorado Attorney General under the Colorado Consumer Protection Act; the act does not create a new private right of action.
